The emergence of a growing European bureaucracy in Brussels once seemed to undermine the traditional nation-state concept, and had buried regional differences. But a powerful united Europe has restored regional nationalisms — in Scotland in the United Kingdom, Brittany in France, the northern region of Italy, and Slovakia in the old Czechoslovakia.

Just when the European Union seemed firmly established and accumulating power, it has been hit by two crises. One is the threat to the common currency, with member nations of the Euro at odds with each other on credits and purchasing power. The avalanche of migrants from the Middle East and Africa reveals Europe as unable to advance a common migrants policy, caught between a declining birth rate and the need for a continuing labor pool, and the cultural threat posed by the swarm of Muslim migrants.

The European dilemma was vividly illustrated when a majority of voters in Catalonia voted for independence. It’s the most economically advanced region in Spain, with a per capita gross national income higher than the average in Europe. Its 7.5 million persons produce 20 percent of Spain’s gross national product and a third of its exports. Barcelona, its most important city, is a growing center for international business, now ranked sixth in Europe.


With an ancient language and cultural traditions, Catalan nationalism has been the subject of Iberian political debate for decades. Catalan autonomy was one of the issues which brought on the bloody civil war of 1936-40, and the nationalists comprised the strongest underground opposition to four decades of the Franco dictatorship.

With the restoration of the Spanish monarchy, the central government has conceded more and more to the region. Spain’s new constitution of 1978 recognized Catalonia among various distinct communities but laid down its doctrine of “indissoluble unity.” In 1979, the Catalans approved by referendum a new autonomy statute giving them more authority for healthcare, education and culture. In 2006, still another autonomy charter, negotiated with the socialist government then in power in Madrid, increased Catalonian fiscal and judicial powers, describing Catalonia as a “nation.”
But in 2012, Mariano Rajoy, the prime minister from the conservative People’s Party, rejected Catalan President Artur Mas’ call for greater authority to tax-and-spend. Last year Sr. Mas’ referendum — in defiance of Madrid — resulted in 80 percent voting for independence but with only 37 percent voting. In the recent election, the two parties representing independence won at least half the regional parliamentary seats, with a promise of independence in 2017.


The migration of low-skill manufacturing to other parts of Spain has driven its politics even further, hit hard by the downturn in Spain’s booming economy before 2008. Unemployment, especially among the young, has stood at 23 percent, well above the 12 percent for the nation.


In Madrid, Sr. Rajoy is caught in a squeeze, with national elections scheduled before December. With strong nationalism in growing the neighboring Basque country, he cannot make further concessions to the Catalan “independendistas.” Other EU governments, faced with similar challenges, have warned that an independent Catalonia would not be welcomed into the Union. This would deny the common currency to Barcelona, important to the increasingly sophisticated international business center. Dark clouds gather over the continent.

Els 5 defectes que fan que la recaptació impositiva catalana sigui excessiva i poc efectiva. Article curt i concís.



Les classes mitjanes són les que més paguen al fisc per culpa d’un sistema injust i que, a més a més, recapta poquíssim en comparació amb altres. Per què la Generalitat no ho canvia si en això té competència?

La fiscalitat de la Generalitat de Catalunya és “absolutament excessiva”. Així és com la defineix Daniel Torroja, cap de departament contenciós tributari de la consultora Crowe Horwth, que es queixa d’un sistema que pressiona massa en comparació a altres comunitats com Madrid, amb les mateixes competències que el català. A més a més, el sistema és inútil perquè, tal com constata Valentí Pich, president del consell general de col·legis d’Economistes, no acaba recaptant molt i, procurant gravar els rics, acaba perjudicant la classe mitjana. De fet, els rics no paguen, perquè tenen la capacitat de formar societats o fundacions que els evitin tributacions molt altes. D’altra banda, els que menys cobren, perquè no paguen IRPF i no tenir patrimoni, tampoc participen en aquest sentit de la criticada política fiscal catalana


 
1-.IRPF de gairebé el 50% que paga la classe mitjana
A Catalunya, el tipus marginal més alt de l’IRPF és un dels més confiscatoris de l’Estat. Un 48% del que s’ingressa es paga en impostos. Un impost que és un exemple d’una mala política, perquè, encara que estaria dedicat a fer pagar els rics, com ja s’ha dit, aquests tenen possibilitat d’evitar-lo. “És un impost que en realitat paga molt poca gent i se’n recapta poquíssim. I pitjor encara, un tipus que tots sabem que no el paguen els rics, sinó una classe mitjana de professionals qualificats”, destaca Pitch.



2-.L’impost del Patrimoni: penalització de l’estalvi de la classe mitjana
De nou, un impost que va dirigit als rics i que, tal com diu Pitch, “no grava als grans patrimonis, sinó a les classes mitjanes que tenen uns estalvis i una segona residència” és l’impost de patrimoni, que també és més alt que el de comunitats com Madrid.



3-. Desincentivant el relleu generacional Ara mateix hi ha un impost de transmissió o donació en vida que desincentiva que els pares passin els seus fills els negocis i esperin que ho heretin una vegada morts (cosa que tributa menys). Un fet que provoca que es retardi el relleu generacional. 



4-.Contra l’estoc immobiliari
L’impost de transmissions patrimonials que grava la compra d’un habitatge també és molt alt a Catalunya. Cosa que es contradiu amb el que seria més recomanable “si tots estem d’acord que per establir les bases de la recuperació econòmica hem d’aconseguir que s’absorbeixi l’estoc d’habitatge que va deixar el crac immobiliari”, recorda Pitch. 



5-.Mentrestant, que ha fet fins ara el govern català d’Artur Mas
Mentre es produeixen tots aquests desequilibris, el govern de la Generalitat, Artur Mas, ha dedicat recursos en preparar una hisenda pròpia per un possible futur Estat Català. Un sistema que ha estat dissenyat per professionals del món fiscal i que possiblement establiria un bon sistema recaptatori. La pregunta és, perquè esperar a un estat propi per millorar la fiscalitat? Per què no aplicar el que ja s’ha dissenyat ara mateix dintre de les competències que la Generalitat té en aquest tema?

Ancora una volta, sem­bra che il governo di Madrid stia cer­cando in tutti i modi di far aumen­tare il numero di cata­lani pronti a strac­ciare la carta d’identità spa­gnola, oggi cer­ti­fi­cato nel 47.8% degli elet­tori in Cata­lo­gna.

Nean­che il tempo di dira­dare la pol­vere della bat­ta­glia elet­to­rale che arriva pun­tuale l’arma più effi­cace per raf­for­zare un pre­si­dente Artur Mas inde­bo­lito dalla man­canza di appoggi par­la­men­tari suf­fi­cienti per coro­nare il suo sogno di tra­sfor­marsi per la terza volta in Pre­si­dent de la Gene­ra­li­tat de Cata­lu­nya. Pro­prio quando la lista Junts pel Sí die­tro le quinte si stava per arren­dere all’eventualità di dover tro­vare un altro can­di­dato più gra­dito al movi­mento indi­pen­den­ti­sta di sini­stra della Cup, arriva l’annuncio che Mas, assieme all’ex vice­pre­si­dente del governo cata­lano Joana Ortega (che è uscita dal governo quando il par­tito alleato di Mas, Unió, ha deciso di abban­do­nare la coa­li­zione alcuni mesi fa) e all’ancora in carica mini­stra dell’istruzione Irene Rigau devono pre­sen­tarsi a dichia­rare come impu­tati davanti al giu­dice il 15 ottobre.

Tra l’altro, una data pro­prio inop­por­tuna: il 15 otto­bre 1940 le truppe fran­chi­ste fuci­la­rono nel castello di Mon­t­juic l’ultimo pre­si­dente demo­cra­tico cata­lano prima dell’avvento della dit­ta­tura, Lluís Com­pa­nys, espo­nente di Esquerra Repu­bli­cana, che ave­vano cat­tu­rato dall’esilio e torturato.

La vicenda giu­di­ziale risale al famoso refe­ren­dum del 9 novem­bre scorso. Il par­la­mento cata­lano con una legge per isti­tuire con­sulte popo­lari l’aveva reso pos­si­bile, ma il governo di Madrid l’aveva impu­gnato ben due volte per cer­car di impe­dirne la cele­bra­zione. Alla fine, il governo di Mas era ricorso all’escamotage di non “con­vo­care” pro­prio nulla, ma di fatto quasi 2 milioni e mezzo di cata­lani si erano recati “infor­mal­mente” alle urne per dire come la pensavano.

Il governo del Pp aveva rea­gito denun­ciando Mas e i due mem­bri del suo governo al pro­cu­ra­tore gene­rale dello Stato (Fisca­lía del Estado) per i delitti di «disob­be­dienza grave, pre­va­ri­ca­zione, appro­pria­zione inde­bita e usur­pa­zione di fun­zioni» per aver «disob­be­dito» all’ordine del Tri­bu­nale Costi­tu­zio­nale di non cele­brare il refe­ren­dum. Assieme al pre­si­dente cata­lano, la vice­pre­si­dente e la mini­stra dell’istruzione (per aver favo­rito l’utilizzo di locali pub­blici, cioè le scuole). Reati molto gravi, che potreb­bero por­tare all’inabilitazione che impe­di­rebbe a Mas e alle altre due impu­tate di eser­ci­tare cari­che pub­bli­che fino a dieci anni.

Tra l’altro, il pro­cu­ra­tore gene­rale cata­lano, assieme ai nove giu­dici che com­pon­gono la pro­cura gene­rale cata­lana (gerar­chi­ca­mente sot­to­po­sta a quella dello stato) si erano rifiu­tati di impu­tare i mem­bri dell’esecutivo di Bar­cel­lona, e hanno dovuto accet­tare l’imputazione per ordine del Fiscal Gene­ral del Estado Eduardo Torres-Dulce, come no, scelto diret­ta­mente dall’esecutivo Rajoy.

Il mini­stro della Giu­sti­zia del governo spa­gnolo, Rafael Català, ha ammesso che si è attesa que­sta set­ti­mana «per non inter­fe­rire» con le elezioni.

Le rea­zioni a Bar­cel­lona non si sono fatte atten­dere. «Ano­ma­lia demo­cra­tica», l’ha chia­mata la por­ta­voce dell’esecutivo cata­lano Neus Munté; Esquerra Repu­bli­cana ha detto che «è un’ulteriore prova che dob­biamo essere indipendenti».

La Cup ha par­lato di uno stato «inqui­si­to­riale» e ha espresso soli­da­rietà a Mas, par­lando di due milioni di disob­be­dienti «feli­cis­simi» di essere impu­tati anche loro; la sin­daca di Bar­cel­lona Ada Colau parla di «disprezzo per la demo­cra­zia». Per i socia­li­sti cata­lani si tratta di una «impu­ta­zione politica».

Íñigo Erre­jón di Pode­mos per twit­ter sostiene che Mas «dovrebbe ren­dere conto della cor­ru­zione e dei tagli, non per aver fatto votare la gente». Intanto il conto alla rove­scia è comin­ciato: al mas­simo entro un mese si deve costi­tuire il nuovo parlamento.

La justice espagnole a convoqué mardi le président indépendantiste catalan Artur Mas pour désobéissance civile en 2014, deux jours après la victoire des séparatistes aux régionales en Catalogne, où son camp a immédiatement dénoncé un "procès politique".

M. Mas est convoqué aux fins d'inculpation pour "désobéissance civile". Il sera entendu le 15 octobre pour avoir organisé fin 2014 une consultation sur l'indépendance de sa région, a-t-on appris mardi de source judiciaire.

"Nous faisons face à un procès politique", a déclaré Neus Munté, porte-parole du gouvernement régional. "Que le parquet et le gouvernement portent plainte contre un président démocratiquement élu (...) pour avoir écouté la voix de son peuple est une énorme anomalie démocratique", a-t-elle ajouté.

La citation à comparaître délivrée par le tribunal supérieur de justice de Catalogne (cour d'appel) a été émise deux jours après la victoire dimanche aux régionales du camp indépendantiste qui a obtenu la majorité absolue des sièges au Parlement régional (72 sur 135).



Les séparatistes n'ont cependant pas la majorité des voix - ils ne sont arrivés qu'à 47,8% -, témoignage de la profonde division de la société catalane sur la question de l'indépendance.

Dimanche soir, M. Mas a affirmé que les indépendantistes avaient ainsi reçu le "mandat" du peuple catalan pour mettre en oeuvre leur programme : mener la plus riche région de la quatrième économie de la zone euro vers l'indépendance en 2017 au plus tard.

- "Laisser la justice travailler" -

M. Mas est convoqué par la justice espagnole pour avoir décidé d'organiser le 9 novembre 2014, au nom de la "liberté d'expression", une consultation sans valeur légale sur l'indépendance de la Catalogne, le gouvernement national (conservateur) de Mariano Rajoy lui ayant refusé depuis 2012 l'organisation d'un référendum d'autodétermination.

Près de 2,3 millions de personnes y avaient participé et 1,9 million s'étaient prononcées pour l'indépendance.

La consultation avait cependant été interdite par le Tribunal constitutionnel, saisi par le gouvernement et dont la majorité des juges sont de tendance conservatrice. Le tribunal avait conclu que le président catalan abordait ainsi un sujet national, l'unité de l'Espagne, qui n'était pas de sa compétence.

La justice a du coup ouvert en décembre une information judiciaire visant M. Mas pour la consultation du 9 novembre. L'enquête pénale, concernant aussi deux autres responsables de l'exécutif catalan, cherche à établir s'il s'est rendu coupable de "désobéissance civile", de "malversations" concernant des fonds publics et d'"usurpation de fonctions", en organisant ce scrutin.

La consultation avait en partie été organisée, avec l'aide de 41.000 bénévoles, par l'exécutif catalan, notamment dans des écoles publiques.

"Ouvrir les écoles (publiques) pour le vote et tout acte de fonctionnaires collaborant en ce sens" peut tomber sous le coup de la désobéissance civile, entrainant potentiellement une interdiction d'exercer.

La convocation intervient à un moment où la coalition indépendantiste Junts pel si (Ensemble pour le oui) dont fait partie M. Mas doit encore négocier avec l'autre liste indépendantiste, la CUP (candidature d'unité populaire, d'extrême gauche), pour former une majorité stable au parlement régional.

La première séance en vue de l'investiture de l'exécutif catalan doit intervenir au plus tard trente jours ouvrables après les élections, soit en novembre, un mois avant les législatives en Espagne.

Mariano Rajoy n'a de cesse de répéter qu'il défendrait la "légalité" et c'est sur ce terrain qu'il entend poursuivre sa lutte.

Son Parti populaire (droite), majoritaire au Parlement national, a déposé une proposition de loi en vue d'une réforme "urgente" des statuts du tribunal constitutionnel.

Le texte permettrait de suspendre M. Mas ou toute autre autorité catalane ignorant les résolutions du tribunal, comme au cours de la consultation symbolique. Il sera discuté jeudi par le Congrès (la chambre basse).

"Tant que nous restons dans l'Etat espagnol, des choses aussi simples que consulter les citoyens deviennent des querelles, des mises en examen, des citations à comparaître", a de son côté estimé le dirigeant indépendantiste de gauche Oriol Junqueras, également sur la liste de Junts pel si.

Le ministre de l'Intérieur Jorge Fernandez Diaz s'est de son côté borné à déclarer qu'il fallait "laisser la justice travailler".

Mardi, les associations indépendantistes Omnium et ANC, également sur la liste Junts pel Si, ont estimé avoir un mandat clair "pour la construction de la république catalane".

Two days after controversial elections in which pro-independence forces won a majority in Catalonia’s parliament, regional leader Artur Mas has been summoned to appear in court to answer accusations of civil disobedience for holding a non-binding referendum on Catalan sovereignty last November.

Mr Mas must appear before judges at Catalonia’s superior court of justice on October 15 to testify after the Spanish state prosecutor’s office accused the regional leader and two other members of his government at the time of the referendum of several crimes, including misuse of public funds in the organisation of the vote.

If eventually put on trial and found guilty of abuse of office for wilfully pressing ahead with a wildcat referendum which Spain’s constitutional court had suspended, Mr Mas could be barred from public office for up to 10 years.

The news of the summons appeared to strengthen support for Mr Mas among his pro-independence allies ahead of negotiations to form a new Catalan government.
Oriol Junqueras, Mr Mas’s leading colleague from the Together for Yes coalition, the platform which treated Sunday’s election as a referendum on its road map towards a unilateral declaration of independence, called the summons “further proof of why we must be independent”.

“I myself and the two million Catalans who voted also disobeyed. If they want to summon us all, we will be delighted”, said Antonio Baños, the leader of the 10 representatives of the far-left, pro-independence CUP party in the new Catalan assembly.

CUP, whose support Together for Yes needs to have an absolute majority, had said on Monday that it would not be supporting the politically conservative Mr Mas as leader of the next regional government.

Neus Munté, the acting deputy premier in the Catalan administration, said the Spanish government was trying to orchestrate a “political trial” against Mr Mas. “The government’s has put the prosecutors under endless pressure”.

On November 9, 2014, Catalans were called to polling stations to give their opinion on whether the region should become a state and whether it should be an independent one.  


According to the results provided by the regional authorities, 2.34 million people voted, a turnout of around 40 per cent, with 81 per cent answering yes to both questions.
 
Separately, Spain’s government is currently fast-tracking a bill through parliament which would give the country’s Constitutional Court the power to suspend elected officials while their actions were being reviewed on the suspicion of being anti-constitutional.

The government has denied that the reform is aimed at Mr Mas, pointing out that it will apply to all state officials.

But opposition parties are united in their rejection of a law described by the Socialist spokesman in Congress, Antonio Hernando, as “barbaric” and an attack on the constitutional provision for the impeachment of officials being the preserve of elected parliaments.
